The Data Act – Ensuring Fair and Transparent Use of Data
The EU Data Act (Regulation (EU) 2023/2854) establishes harmonized rules on accessing, using, and sharing data generated by connected products and related services. Its objective is to promote innovation, strengthen competition, and ensure that data is used under fair and transparent conditions.
Key provisions for users and partners:
- Right of access: Obtain data generated by users connected devices and services.
- Right to share: Authorize third parties of user’s choice to access this data.
- Transparency obligations: Clear information on how and under what terms data is used.
- Contractual fairness: Protection against unfair or one-sided terms regarding data use.
Definitions of connected products, related services and data in scope
What is a Connected Product?
An item that obtains, generates or collects data concerning its use and can communicate product data.
Example: Connected fridge, washing machine or air purifier
What is a Related Service?
Anything that would make a connected product behave in a specific manner, such as an app to adjust the brightness of lights, or to regulate the temperature of a fridge. to access the data that they co-create by using the connected products/related services.
Example: A user buys a washing machine and installs an application that allows them to measure the environmental impact of the washing cycle based on the data from the different sensors inside the machine and adjusts the cycle accordingly. This application would be considered a related service.
For Electrolux we have identified the App as a related service.
Definition of Data in scope
- Data means any digital representation of acts, facts or information including sound, visual or audio-visual recording.
- All raw and pre-processed data generated from the use of a connected product or a related service that is readily available to Electrolux (data that can be easily accessed)
- This applies to both personal and non-personal data, including relevant metadata.
- Such data includes data collected from a single sensor or a connected group of sensors, such as temperature, pressure, flow rate, audio, position, acceleration or speed.
Data sharing to users
Users have new rights of the data generated by use from connected products & related services.
- Electrolux needs to give access to all data generated by use from connected products and related services when a user requests it.
- From 12 Sep 2026, the design and manufacturing requirement comes into effect, and data should be directly accessible to the user, where relevant and technically feasible.
- The data should be shared in a standard, simple, secure, machine-readable format and free of charge.
- Electrolux is free to determine which data should be “retrievable” and thus made available to the user.
- Electrolux needs user acceptance to be able to process (use) the appliance data. In the agreement, Electrolux must indicate to users which data it wishes to use for which purposes.

- the type, format and estimated volume
- if the connected product generates continuously and in real-time
- ability to store data on-device or on a remote server

Users can access their product data by sending a request to appliance.data@electrolux.com.
Data sharing to third party (on behalf on user request)
- Users can request Electrolux to share data to third parties, for example, when the third party needs the data to provide additional services, when logged in to our website www.electrolux.com
- Before any data is shared with the Third Party, the request will be reviewed, a contract between Electrolux and the Third Party needs to be completed and users need to give consent to share the data.

Third party access revoking by user
In the Electrolux app, users will have the functionality to unlink third party revoking the access.
Data sharing to Government/Public bodies
- In case of public emergency or when impossible to perform a task in the public interest, if the data cannot be obtained otherwise, public bodies within EU have the right to request data from connected products and related services
- Those requests should be directed to datasharingrequest@electrolux.com.
Compliance with data protection law
We will not use, share with third parties or otherwise process any Data that is personal data unless this is permitted under Regulation (EU) 2016/679 (GDPR) and, where relevant, Directive 2002/58/EC (Directive on privacy and electronic communications).
